A class action lawsuit has been filed against major US retailers on behalf of all past and present
employees whose overtime was improperly calculated. This overtime pay is commonly referred
to as Chinese Overtime. The suit alleges that these companies did not include incentive pay,
such as commissions, bonuses, SPIFFS, credit card incentives, etc. when calculating overtime
rates. The class includes any employee who is or has been paid some form of overtime pay in
any position at any time within the past three years, as well as any employee who has received
at least some incentive pay and whose overtime calculation did not include credit for the
incentive pay.
